Terms

These terms apply to the Noisy Laptop Mac app and to the website at noisylaptop.com, both provided by Garded LLC, 150 Central Park S, New York, NY 10019, USA. By downloading, installing or buying Noisy Laptop you agree to them. They are deliberately short.

What you get

• Free. Noisy Laptop is free to download and use. The free version covers the “charger connected” and “charger disconnected” events with the Classic sound pack. There is no time limit, no trial period and no account. We may change what the free version includes in future releases, but a version you have already installed keeps working.
• Noisy Laptop Pro. A one-time purchase of $6.99 that unlocks every event, every sound pack, per-event sounds and volumes, and the use of your own audio files.
• Licence. A Pro purchase gives you a personal, non-exclusive, non-transferable licence to use Noisy Laptop on the Macs you own or control, together with free updates for version 1. You can deactivate a Mac from inside the app and activate another one instead.
• What you may not do. Resell, sublicense, publish or share licence keys; work around the licence check; or redistribute the app or its sound files as your own.

Payment and refunds

• Purchases are processed by Lemon Squeezy, which is the merchant of record and whose own terms apply to the transaction. Your contract of sale is with them; your licence to use the software is with us.
• Refunds are handled case by case on request, and are processed by Lemon Squeezy. If you're not happy with Noisy Laptop, email thisdudestartedsomething@gmail.com and we'll sort it out. A refunded licence is deactivated.
• Where you have statutory cancellation or refund rights — for example as a consumer in the EU or UK — those rights apply in addition to this and are not reduced by it.

The sounds

The sound packs are original recordings and production, together with material licensed for this use. Where a pack requires attribution, it is credited in the app and in the footer of this website. Your licence lets you use the sounds inside Noisy Laptop on your own Macs, including in videos you make of your own screen. It does not let you extract the audio files and redistribute, resell or relicense them, or use them as stock audio in other products.

Some packs contain adult humour and are labelled as such in the app. They are never selected by default and only play if you choose them.

Sounds you add yourself

Noisy Laptop lets you use your own audio files. You are responsible for having the right to use any file you add, and for what you do with any recording you make with it. Your clips stay on your Mac; we never receive them and cannot moderate them.

The website

The site is provided for information and for previewing the product. The sound previews, the typing demo and any audio you drop into the page run in your browser. Please don't attempt to scrape, mirror or bulk-download the audio files.

No warranty

Noisy Laptop is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that it will be uninterrupted or error-free, or that every event will fire on every Mac in every configuration. Nothing here excludes any warranty or right that cannot lawfully be excluded, and consumers may have rights that this section does not affect.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to Noisy Laptop is limited to the amount you actually paid for it. We are not liable for indirect or consequential loss — including, but not limited to, a very dramatic charger sound going off in a quiet library. Again, nothing here limits liability that cannot lawfully be limited.

Ending it

You may stop using Noisy Laptop at any time by quitting it and deleting it. We may terminate a licence that is being used in breach of these terms, in which case you should stop using the software; if we do so without cause, we will refund you.

Trademarks

Noisy Laptop is not affiliated with, endorsed by or sponsored by Apple Inc. Mac, MacBook, macOS and AirPods are trademarks of Apple Inc. Other names are the property of their owners and are used only to describe what the software works with.

Governing law

These terms are governed by the law of the State of Delaware, USA, and disputes will be heard in the state and federal courts located in New York County, New York, without affecting any right you have to bring proceedings in the courts of the country where you live.

Changes

We may update these terms. The date at the top changes when we do, and continuing to use Noisy Laptop after a change means you accept the updated version. Questions: thisdudestartedsomething@gmail.com.
